Payment: If represented by counsel, we will send an invoice to counsel by email shortly after the mediation. Counsel is responsible for payment. Payment is expected and appreciated no later than fourteen (14) days after we send the invoice. We accept the following forms of payment for your convenience:

Costs for Mediation: All charges and costs such as mediation time, travel time, parking, room fees (if applicable) will be divided equally among the participants unless the parties agree to divide the charges differently. If the parties cannot agree, ESP Mediation Group shall determine the number of participants to be charged. Mediation time shall be billed at $350.00 per hour, with no additional fees for administration. A minimum of two (2) hours will be charged for your mediation. However, if the parties request more than two (2) hours be reserved in advance, then a minimum of four (4) hours will be charged. 

  • In the event that an in-person mediation is required in any location other than ESP Mediation Group's office or office of counsel, any charges incurred by ESP Mediation Group to reserve conference room space will be passed on to the parties equally.   

  • Generally, there is no additional charge for review of materials sent in advance of mediation, unless a party chooses to send an unusually large amount of materials for the mediator's review in preparation for mediation. ESP Mediation Group reserves the right to charge said party for the mediator's actual time spent reviewing voluminous materials at a reduced rate of $300.00 per hour.

  • Cancellation Policy:  Whether your mediation is voluntary or court ordered, mediations can only be cancelled, modified or rescheduled if all parties are in agreement or as ordered by the court. No charges are incurred if your mediation is rescheduled with our office for a later date irrespective of the amount of notice you provide. The parties will be charged the applicable minimum of time (2 or 4 hours) for all cancellations due to settlement (or otherwise cancelled without possibility of rescheduling), when our office receives notice of cancellation less than twenty-four (24) hours prior to the date scheduled for mediation. Please do not assume that other participants have timely notified us of cancellation. We recommend parties e-mail bianca@espmediationgroup.com with a copy to all parties to advise of cancellation to avoid miscommunication.

Special Needs: In the event of special safety or health concerns, or other special needs, please advise us in advance and prior to the date of mediation so we have an opportunity to accommodate the needs of all concerned.

Confidentiality and Mediator's Role as a Neutral: By your receipt and acceptance of a notice of mediation from ESP Mediation Group, all participants agree and acknowledge that the mediation, whether pre-suit, voluntary, in-suit or court ordered, shall be subject to all applicable statutes and rules with respect to mediator immunity and mediation confidentiality. It is further agreed and acknowledged that the mediator is a neutral and may not provide legal advice, representation or legal service to any participants of the mediation conference. Additionally, in the event that the parties agree to allow non-parties to participate, such as experts, consultants, public adjusters, etc., such non-party participants shall be bound by the same rules and statutes of confidentiality that govern the parties.
